This Acceptable Use Policy outlines the rules and guidelines for using SmartForm. By using our service, you agree to comply with this policy.
2. Prohibited Activities
You may NOT use SmartForm to:
- Illegal Activities: Collect, store, or process data for any illegal purpose
- Fraud: Create forms that deceive users or misrepresent facts
- Phishing: Create forms that impersonate legitimate services to collect credentials
- Spam: Distribute unsolicited communications or promotions
- Harassment: Collect or process data to harass, intimidate, or harm others
- Malware Distribution: Distribute viruses, malware, or harmful code
- Data Collection Violations: Collect data without proper consent where required
- System Abuse: Overload, disrupt, or gain unauthorized access to our systems
- API Abuse: Exceed rate limits or use automated tools without authorization
3. Child Safety - Zero Tolerance
SmartForm has a ZERO TOLERANCE policy for any content involving minors.
- No Uploads of Minor Photos: You may NOT upload photos of children or minors under any circumstances
- No AI Generation of Minor Content: You may NOT use AI features to generate, modify, or create any content depicting minors
- No Child Sexual Abuse Material (CSAM): Any content that depicts, describes, or involves minors in sexual situations is strictly prohibited and will be reported to authorities
- Age Verification: You must verify that any individual whose image or voice is captured has provided appropriate consent
Violations of this section will result in immediate account termination and mandatory reporting to law enforcement authorities.
4. Content Restrictions
Forms and content must not include:
- Adult content, pornography, or sexually explicit material
- Violent, threatening, or hate speech content
- Defamatory, libelous, or invasive personal content
- Copyrighted material without proper licensing
- Content that infringes on intellectual property rights
5. Data Handling Requirements
When collecting data through SmartForm:
- You must have appropriate consent to collect personal information
- You must comply with applicable data protection laws (GDPR, CCPA, etc.)
- You must provide clear privacy notices to form respondents
- You are responsible for the security of data you collect
- You must delete data when no longer needed or when requested by respondents
6. Voice and Image Data
When using voice input, image upload, or doodle features:
- You must have consent from individuals before recording or capturing their voice/images
- You may not use these features to capture data covertly or without awareness
- Processed data must be handled according to your privacy policy
- You must ensure that no images of minors are uploaded or processed
7. AI Feature Usage
When using AI features:
- AI outputs should be reviewed before critical decisions
- You may not use AI to generate content that violates this policy
- Field extraction results should be validated for accuracy requirements
- AI features use DeepSeek for form generation and field extraction, and Whisper API (OpenAI) for speech-to-text transcription
8. Webhook and Integration Usage
When configuring webhooks:
- You must protect webhook endpoints from unauthorized access
- You may not use webhooks to send data to illegal or prohibited services
- You are responsible for data transmitted through your webhooks
9. Enforcement
Violations of this policy may result in:
- Removal of prohibited content
- Temporary suspension of your account
- Permanent termination of your account
- Reporting to law enforcement authorities
10. Reporting Violations
If you become aware of content or activity that violates this policy, report it immediately to support@smartform.com.
Report Processing Time: We commit to reviewing and taking action on all reported violations within 24-48 hours. For urgent matters involving potential illegal content or immediate safety concerns, please also contact local law enforcement directly.
When reporting, please include:
- Description of the violating content or activity
- URL or form ID where the violation occurred
- Your contact information (optional, for follow-up)
11. Policy Changes
We may update this policy periodically. Continued use of the service constitutes acceptance of any changes.
